International Arbitration

  • Representing a major UAE-based shipping company in two shipbuilding contract disputes arising from the termination of a shipbuilding agreement, initiating arbitration proceedings at the London Maritime Arbitrators Association (LMAA). The arbitration is seated in London, governed by English law, with aggregate disputed amounts exceeding USD 30 million.
  • Representing the Middle Eastern subsidiary of a major Chinese building materials group in an international trade contract dispute with a Kuwaiti energy company concerning industrial product procurement, in arbitration before the Dubai International Arbitration Centre (DIAC). The arbitration is seated in Dubai, governed by UAE law, with a disputed amount of nearly USD 3 million.
  • Representing the Middle Eastern subsidiary of a leading Chinese chemical company in an international trade contract dispute with a Pakistani purchaser concerning chemical product sales, in arbitration before the Dubai International Arbitration Centre (DIAC). The arbitration is seated in Dubai, governed by UAE law.

Litigation in the UAE and Cross-Border Recognition and Enforcement of Judgments

  • Coordinated with an international legal team to provide legal services to a Hong Kong trading company in its advertising service contract dispute with a UAE advertising company, initiating proceedings before the Dubai courts and recovering over RMB 6 million for the client.
  • Coordinated with an international legal team to provide legal services to a UAE-based building materials company in an unfair competition dispute with a competitor, defending the claim before the Dubai courts and successfully avoiding nearly RMB 1 million in losses for the client.
  •  Coordinated with an international legal team to provide legal services to the Dubai subsidiary of a Chinese smart technology company in a sales contract dispute with a UAE technology service company, defending the claim before the Dubai courts. The court of first instance dismissed the claim on the ground that the plaintiff had sued the wrong party, and the court of appeal upheld the ruling, successfully avoiding over USD 1 million in losses for the client.
  •  Coordinated with an international legal team to provide legal services to a leading Chinese construction machinery manufacturer in connection with the recognition and enforcement in the UAE of a final judgment rendered by a court in Shandong Province (with a subject amount of approximately RMB 50 million) against a senior executive of a Chinese company.
  •  Coordinated with an international legal team to provide legal services to a well-known Chinese investment enterprise in connection with the recognition and enforcement in the UAE of a final judgment rendered by a court in Shanghai (with a subject amount of approximately RMB 20 million) against the legal representative of a Chinese company.

Commercial Dispute Resolution in Mainland China

  • Successfully represented a real estate company in a real estate cooperative development contract dispute with a tourism and cultural development company, a construction and development company, and an investment company. Following the second-instance trial before the Nanning Intermediate People’s Court of Guangxi Zhuang Autonomous Region, the original unfavorable situation was reversed, compelling the opposing parties to enter into settlement negotiations, and ultimately secured a comprehensive settlement agreement and an enforceable civil mediation paper, recovering tens of millions of RMB in losses for the client.
  • Successfully represented a real estate development company in a shareholder loan dispute with an investment partnership (limited partnership) and an investment company. After first-instance proceedings before the Shenzhen Futian District People’s Court and second-instance proceedings before the Shenzhen Intermediate People’s Court, we ultimately obtained a favourable judgment, recovering nearly RMB 100 million in losses for the client.
  • Successfully represented a real estate development company in a guarantee contract dispute with two natural persons before the Shenzhen Court of International Arbitration (SCIA), persuading the arbitral tribunal to adopt our arguments, maximizing the client’s objectives, and safeguarding the client’s interests as a guarantor.
  • Represented an asset management company in a series of fund contract disputes with dozens of investors before the Shenzhen Court of International Arbitration (SCIA). Throughout the handling of the series of cases, we guided the client in collecting evidence relating to suitability obligations and assisted in the notarization of online materials, fully demonstrating that the distributor had fulfilled its suitability obligations during the fund sales process, thereby achieving the client’s objectives.
  • Successfully represented a well-known domestic investment company and its affiliated venture capital fund as the respondent in response to an application to set aside a foreign-related arbitral award rendered by the Guangzhou Arbitration Commission. Following the hearing before the Guangzhou Intermediate People’s Court of Guangdong Province, the applicant withdrew its application, thereby preserving the significant results the client had achieved in the earlier arbitration stage.
  • Successfully represented a state-owned enterprise in initiating enforcement reversal proceedings against a Shenzhen branch of a financial asset management company before the Shenzhen Futian District People’s Court after prevailing in a retrial, and filed an enforcement objection during the enforcement reversal proceedings, ultimately securing the calculation of enforcement reversal interest based on the prevailing Loan Prime Rate (LPR) rather than the deposit rate, thereby recovering over RMB 7 million in losses for the client.
  • Successfully represented a real estate company as the enforcement applicant in joining multiple shareholders of the judgment debtor as enforcement defendants after the termination of enforcement proceedings, thereby enabling further enforcement despite the initial unavailability of executable assets, and recovering substantial economic losses for the client.
  • Applied for compulsory enforcement of a foreign-related arbitral award in connection with cross-border M&A transactions involving a well-known domestic investment company and its affiliated venture capital fund before the Beijing First Intermediate People’s Court, with a disputed amount exceeding RMB 200 million.
